Governing Law and Dispute Resolution These Terms of Use are governed by and construed in accordance with the laws of Switzerland, without regard to its conflict of law provisions.

Any dispute, controversy, or claim arising out of or in connection with these Terms of Use, or the breach, termination, or invalidity thereof, shall be finally settled by arbitration administered by the International Chamber of Commerce (ICC) under its Rules of Arbitration. The seat of arbitration shall be Geneva, Switzerland. Proceedings shall be conducted in English. The arbitral award shall be final and binding on the parties.

Nothing in this clause prevents either party from seeking urgent interim relief from a competent court where necessary to preserve rights pending arbitration.

Waiver and Severability No waiver by eCurrency of any term or condition set forth in these Terms of Use shall be deemed a further or continuing waiver of such term or condition, and any failure of eCurrency to assert a right or provision shall not constitute a waiver of such right or provision. If any provision of these Terms of Use is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable, such provision shall be eliminated or limited to the minimum extent necessary so that the remaining provisions continue in full force and effect.
Entire Agreement These Terms of Use, together with our Privacy Policy, constitute the sole and entire agreement between you and eCurrency with respect to the Website and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral.
